J6 Defendant Who Faced Numerous Charges Connected To Capitol Riot Reportedly Requested That Donald Trump Be Subpoenaed As A Trial Witness In His Case

In yet another twist, a recent report from The Hill has revealed that a January 6th defendant who is facing multiple charges in connection to their participation in the infamous, violent Capitol insurrection has requested that a subpoena be issued to ex-President Donald Trump, as well as other notable names, as a trial witness in their case.

Recently, attorney Samuel Shamansky, who represents Jan. 6th Capitol riot defendant Dustin Thompson, submitted a court filing on Thompson’s behalf asking a judge to give the okay on issuing subpoenas to former President Donald Trump and various others to serve as witnesses in Thompson’s upcoming trial.

“Defendant submits that the individuals he seeks to subpoena are in exclusive possession of information relevant to this case. Moreover, their testimony is necessary to ensure that Defendant’s constitutional right to present a complete defense is safeguarded,” the court filing reads.

“It is anticipated that, when called as a witness, Donald J. Trump will testify that he and others orchestrated a carefully crafted plot to call into question the integrity of the 2020 presidential election and the validity of President Biden’s victory,” the document goes on to add. “Moreover, it will be established at trial that Mr. Trump and his conspirators engaged in a concerted effort to deceive the public, including Defendant, into believing that American democracy was at stake if Congress was permitted to certify the election results.”

Shamansky indicates on Thompson’s behalf that should Trump and others testify in his client’s case, it would reveal that the ex-president and his comrades specifically wanted to prevent Congress from certifying the 2020 presidential election results and thereby overturning Joe Biden’s rightful election win.

“Defendant submits that the testimony of Mr. Trump and his conspirators will establish that they were determined, by any means necessary, to prevent Congress from fulfilling its constitutional mandate to certify the election results,” the court filing reads. “In order to accomplish that goal, the conspirators Defendant now seeks to subpoena engaged in a concerted effort to organize, encourage, and direct rally participants to storm the Capitol, enter the grounds, ‘fight like hell,’ and ‘engage in trial by combat.'”

Among the others that Thompson seeks to compel to testify through his attorney are former Trump lawyer Rudy Giuliani, former White House chief strategist Stephen Bannon, conservative lawyer John Eastman, pro-Trump lawyer Sidney Powell, and Donald Trump Jr.”

According to the defendant’s lawyer, they expect a decision on their court filing to be made soon, but fully recognizes the legal challenges they will face even if their subpoena request is granted.

“If and when Judge Walton approves our issues for a subpoena, we fully expect Trump and his co-conspirators to utilize every legal trick in the book to avoid being placed under oath,” Thompson’s attorney said.

Per the report from The Hill, “The defendant has been charged with obstruction of an official proceeding and aiding and abetting; theft of government property; entering and remaining in a restricted building or grounds; disorderly and disruptive conduct in a restricted building or grounds; disorderly conduct in a Capitol building and parading, demonstrating or picketing in a Capitol building.”

Thompson’s statement of facts and complaints states that security footage showed him inside the Capitol building on January 6th holding a bottle of bourbon. The court filing also accuses Thompson of running away from law enforcement officials after he was found with a coat rack that officers believed came from inside the building.
