It hasn’t even been 48 hours since the announcement that former President Joe Biden has been diagnosed with late-stage prostate cancer, and one Justice Department official is already calling for his wife to be put in jail.
At issue is the implication, not backed up at this point by any evidence, that Biden had been diagnosed with cancer much earlier than he says and, therefore, hid the condition from the American people. Several doctors have expressed opinions, although none of them are Biden’s doctor or appear to have seen his medical charts.
Leo Terrell is a former Fox News contributor who now works in the Justice Department as senior counsel to the assistant attorney general for civil rights. Like many other Fox News veterans now working in the Trump Administration, he has continued to behave a lot like a Fox News employee even while in government.
Terrell shared an X post from Ian Jaeger on Monday. His bio describes him as a “Men’s physique bodybuilder, Political Commentator.” The post shares a picture of Jill Biden with the caption, “She knew about President Biden’s health problems. But still wanted him to run for President. Evil.”

To that post, Terrell added, “Elder Abuse! Criminal Charges??”
We are a long way away from any criminal charges. We don’t know for a fact that Biden had cancer during his presidency; that remains merely a theory. It’s unclear what criminal charge Jill Biden could face for whatever she did. In a relatively junior position in a division with a different specialty, Terrell isn’t in any position to make decisions about such a prosecution. Nor would even the Trump Administration likely prosecute Jill Biden while her husband is facing a possible terminal illness.
That said, a Justice Department official spouting on social media about criminal charges for a former first lady would have been almost entirely unthinkable in any non-Trump presidential administration.
Others went even further, accusing Jill Biden of “treason.”

Donald Trump himself was classier when he reacted to the news of Biden’s diagnosis, stating on Truth Social that “Melania and I are saddened to hear about Joe Biden’s recent medical diagnosis… We extend our warmest and best wishes to Jill and the family, and we wish Joe a fast and successful recovery.”
