Donald Trump’s disgraced former national security adviser Gen. Michael Flynn has filed a complaint to stop a subpoena from the House Select Committee to Investigate the deadly January 6 attack on the U.S. Capitol. The complaint somehow alleges that the subpoena was issued without legal authority. Congress does have the power to issue subpoenas, though, so I’m not sure what he’s trying to do here.
The filing, which names all nine members of the Select Committee, claims that Flynn had no part in organizing, speaking at, or actively participating in the rallies on January 6.
“At the times relevant herein, General Flynn was and is a private citizen. Like many Americans in late 2020, and to this day, General Flynn has sincerely held concerns about the integrity of the 2020 elections,” the complaint reads. “It is not a crime to hold such beliefs, regardless of whether they are correct or mistaken, to discuss them with others, to associate with those who share the same belief, or to ask the government to address such political concerns. Indeed, it is our fundamental Constitutional right to speak about and associate around political issues that concern us, and to petition our government about those grievances.”

Flynn was pardoned by the twice-impeached one-term president after losing the election to Joe Biden. Flynn pleaded guilty twice to lying to the FBI in the Russia probe. So, it’s not too surprising that he’s caught up in the January 6 probe. Flynn’s subpoena refers to an Oval Office meeting he “reportedly attended” on December 18, 2020,” Rolling Stone reported.
“At the meeting in question, participants apparently “discussed seizing voting machines, declaring a national emergency, invoking certain national security emergency powers,” as well as the best ways to continue messaging that the 2020 election was marred by widespread fraud,” the outlet adds.
Flynn has been a prominent conspiracy theorist, circulating Trump’s big lie of widespread voter fraud that didn’t occur in the election.
