Republican Texas Governor Greg Abbott has already had a rough start to his week, after testing positive for the potentially fatal coronavirus just mere hours after attending a very large public event. But the bad news didn’t stop there for the southern, Trump-loving governor.
According to multiple new reports, Abbott is now facing down a massive lawsuit from 14 different children and their parents over his DeSantis style ban against mask mandates in the state of Texas.
Per a report from local KXAN News in Texas, 14 child plaintiffs and their families, three of which hail from central Texas, have smacked the Conservative governor as well as the Texas Education Agency Commissioner Mike Morath with a federal lawsuit. The local report cites the advocacy group Disability Rights Texas as their source on the matter.
Recently, Abbott instituted an executive order in the state that bans school districts from enforcing any sort of mask mandate in school systems — a la Florida’s governor. The lawsuit alleges that this executive order puts children with disabilities “at significant risk, is discriminatory, and violates the federal Americans with Disabilities Act and Section 504 of the federal Rehabilitation Act.”

The suit asserts that Abbott’s mask mandate ban directly discriminates against children with disabilities and hinders them from fully taking advantage of their right to public education programs.
The plaintiffs in the federal lawsuit have a variety of different disabilities, all with various levels of severity. They state that their underlying medical condition could very likely put them at extremely high risk for serious complications and even death as a result of a COVID-19 infection.
The goal of the lawsuit is to acquire a federal temporary restraining order that would effectively cut off the enforcement of Abbott’s executive order and give school districts and local public health authorities to once again freely mandate masks in their institutions.
According to the report, 14 anonymous children are included in the federal lawsuit, ranging in ages from 7 to 11 years old.
